These Terms of Service ("Terms") govern your use of the Profilewise platform and services provided by Profilewise Ltd. ("Company", "we", "us", or "our"). By accessing or using our service, you agree to be bound by these Terms.

1. Service Description

Profilewise is an AI-powered recruiting platform that helps companies find potential candidates by analyzing publicly available professional information and job requirements. Our service provides:

• Candidate matching based on job requirements
• Analysis of publicly available professional profiles
• Email notifications for new matches
• Dashboard for managing job profiles and viewing matches

2. Eligibility and Account Registration

You must be at least 18 years old to use our service. By creating an account, you represent and warrant that:

• You are legally capable of entering into binding contracts
• All information you provide is accurate and current
• You will maintain the accuracy of your information
• You will keep your login credentials secure

You are responsible for all activities that occur under your account.

3. Subscription Plans and Billing

3.1 Available Plans

3.2 Free Trial

New users receive a 30-day free trial with Starter plan features. No payment method is required to start your trial. Your trial will automatically expire after 30 days unless you subscribe to a paid plan.

3.3 Billing Terms

• Subscriptions are billed monthly in advance
• Fees are non-refundable except as expressly stated in these Terms
• We use Stripe for payment processing
• Price changes will be communicated 30 days in advance
• Failed payments may result in service suspension

4. Data Sources and Accuracy

Our service analyzes publicly available professional information from various sources across the internet. We use AI technology to process and match this information with your job requirements.

5. Acceptable Use

You agree to use our service only for legitimate recruiting and hiring purposes. You may not:

• Use the service for any unlawful purpose or in violation of any laws
• Attempt to reverse engineer or replicate our technology
• Share your account credentials with others
• Use automated tools to access the service
• Harvest or collect data for purposes other than recruiting
• Contact candidates for spam, marketing, or non-recruiting purposes
• Violate any third-party platform's terms of service when contacting candidates

6. Intellectual Property

6.1 Your Content

You retain all rights to job descriptions, requirements, and other content you upload to our service. By using our service, you grant us a limited license to process your content to provide our matching services.

6.2 Our Technology

Our matching algorithms, software, and analysis results are our proprietary technology. Match results and compatibility scores generated by our system are provided for your internal recruiting use only.

7. Data Retention and Privacy

We handle your data according to our Privacy Policy. Key points:

• Matched candidates and your job profiles are stored to provide ongoing service
• Unmatched candidate data is automatically deleted within 24 hours
• You can delete your job profiles and associated matches at any time
• Upon account termination, your data will be deleted within 30 days

8. Service Availability

While we strive for maximum uptime, we do not guarantee uninterrupted access to our service. We may temporarily suspend service for maintenance, updates, or due to factors beyond our control. We are not liable for any downtime or service interruptions.

9. Termination

9.1 By You

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period.

9.2 By Us

We may terminate your account immediately if you violate these Terms or for any reason with 30 days' notice. Upon termination, you will lose access to the service and your data will be deleted as described in Section 7.

10. Disclaimers and Limitation of Liability

10.1 Service Disclaimers

Our service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

• Accuracy or completeness of candidate information
• Availability or reliability of the service
• That candidates will be suitable for your positions
• That the service will meet your specific requirements

10.2 Limitation of Liability

11. Third-Party Services

Our service may integrate with or reference third-party platforms and services. We are not responsible for the availability, content, or terms of service of third-party platforms. When contacting candidates through third-party platforms, you must comply with those platforms' terms of service.

12. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the service at least 30 days before they take effect. Your continued use of the service after changes take effect constitutes acceptance of the new Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the service will be resolved through the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
